Evaluation Agreement

asks you to accept it before anything is written to your computer.
Please read this before installing. Installing the evaluation copy means you accept these terms. If you do not accept them, do not install it.
1. What You May Do
We grant you a licence to install and use this evaluation copy of Heronix Forms, for 90 days, to decide whether to buy it. You may install it on as many machines as you need for that purpose, within one school, district or organisation. The licence is not exclusive and you may not transfer it.
2. What You May Not Do
You may not use this copy to run any part of your real operations. It is a demonstration: it is deliberately not secured for production, and section 4 explains why that matters.
You may not enter real information about any identifiable person. Use made-up names, dates of birth, contact details and medical details. Never a real student, patient, parent or member of staff.
You may not redistribute, sell, rent or publish this copy, or give it to anyone outside your organisation, without our written permission. You may not reverse engineer, decompile or modify it, except where law expressly gives you that right despite this agreement. You may not remove or obscure any notice of ownership.
3. The 90 Days, and What Happens at the End
The 90 days start the first time you run the evaluation copy on a machine. A banner shows the days remaining.
At the end, the software permanently erases everything it holds - every form, response, uploaded file, signature, invitation, account, log and backup - and then shows only a page saying the demonstration has ended. It does not start over, and setting the computer's clock back does not extend it. This licence ends at the same moment.
Export anything you want to keep before then. We are not able to recover it afterwards, and we are not liable for anything lost this way.
4. This Copy Is Not Secure, by Design
An evaluation copy is built to be handed around and tried quickly. The sign-in password is published in the documentation that comes with it, the key that encrypts stored data ships inside the program itself, and it serves plain HTTP on the machine it runs on. Anyone who can reach that machine can read everything in it.
This is why section 2 forbids real information. A licensed installation is configured properly, with a private encryption key and HTTPS.
5. Pre-Beta Software
This is a pre-beta release under active development. Features may change, may be incomplete, and may not work. That is expected at this stage.
6. Feedback
If you send us feedback, suggestions or bug reports, we may use them to improve our products, without payment or obligation to you. You keep whatever rights you already had in what you sent; you are simply letting us act on it. Please do not send us anything confidential, and never send real student records.
7. What We Do Not Promise
This evaluation copy is provided "as is" and "as available", without any warranty of any kind, express or implied. To the fullest extent the law allows, we disclaim the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise it will be uninterrupted, error-free, or that it will keep your data.
This section does not limit any warranty that comes with a paid, licensed installation - that is a separate agreement.
8. Limit of Our Liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for lost data, lost profit or business interruption, arising from your use of this evaluation copy. Our total liability relating to it will not exceed one hundred United States dollars (US$100).
Nothing here excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.
9. Ownership
We own this software and keep all rights that this agreement does not expressly give you. You own whatever you put into it, for as long as it survives - see section 3.
10. Ending This Agreement
This licence ends automatically after 90 days, or if you break any term of it, or if you uninstall the software. On ending, stop using the software and remove it. Sections 4 and 6 to 11 continue to apply afterwards.
11. Governing Law
This agreement is governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, consistent with the Heronix Terms of Service at https://heronixedu.com/terms-of-service.
12. The Whole Agreement
This is the entire agreement between us about the evaluation copy, and it replaces anything said or written before it. If a court finds any part of it unenforceable, the rest stays in force. If you have signed a separate written agreement with us covering evaluation software, that agreement wins where the two conflict.
